Eilat Free Trade Zone

A Quiet Benefit or a Honey Trap?

The Eilat Free Trade Zone Law grants one of the most significant tax benefits in Israel – VAT exemption (zero rate) on numerous transactions. However, for many business owners, this "tax paradise" quickly turns into a battleground against the Israel Tax Authority. The mistaken assumption that "all activity in Eilat is VAT-exempt" leads to massive retroactive tax assessments. The Tax Authority scrutinizes transactions with residents of "the North" (the rest of the country), online sales, and remotely provided services. Even the slightest error in classifying a transaction or proving "Eilat residency" can prove extremely costly.

Eilat Free Trade Zone Law

The law sets strict rules for eligibility for tax benefits (VAT exemption on the sale of goods, provision of services, and more). To enjoy the exemption, it is not enough for the business address to be in Eilat. The law requires meeting substantive tests, such as:

  • The dealer being a "resident of the Eilat zone" (including management and control of the company from within Eilat).

  • The goods are sold for consumption within the Eilat zone.

  • The service is provided and consumed within the Eilat zone (a particularly complex issue in the digital era). Failure to meet these conditions requires the dealer to charge full VAT, even if physically located in Eilat.

We don't just defend clients after the fact in assessment proceedings – we guide businesses in building a proper operational structure that ensures the exemption is granted. We know how to prove a "center of life" and genuine business activity in the city, and how to draft agreements with suppliers and clients outside Eilat to minimize tax exposure. Our goal: to ensure your exemption is solid and will not be overturned at the first audit.

Questions & Answers

Is an online store managed from Eilat exempt from VAT on sales to customers in central Israel?
Generally, no. If the goods are shipped to a customer outside the Eilat zone, the transaction is subject to full VAT, even if the warehouses and offices are located in Eilat.
I provide consulting services from Eilat to a company in Tel Aviv. Am I exempt from VAT?
This is a complex issue. In most cases, if the service is consumed by the client outside Eilat, VAT must be charged. However, there are exceptions and legitimate tax planning strategies that can be explored depending on the nature of the service.
What is required for a company to be considered an "Eilat resident"?
A registered address alone is not sufficient. It must be demonstrated that there is substantive business activity in the city, employment of local residents, and that management and control are actually conducted from Eilat.
Is purchasing a vehicle in Eilat always VAT-exempt?
No. The exemption applies only to Eilat residents (of at least 12 months) and to dealers who are Eilat residents, and even then – the vehicle must be used primarily within the Eilat zone. Deviation from this may result in a demand for full VAT payment.
